AREAS OF PRACTICE

Simply put, we handle ALL criminal charges under Georgia and Federal law anywhere in Georgia.  Misdemeanors, Felonies, DUI and traffic: from the smallest offense to the “7 deadly sins,” we fight for client’s rights no matter the charge.  Why?  Our philosophy is that we are defending your rights. 

 

Whether you are innocent or guilty, you have certain inalienable rights guaranteed by our Constitution.  Those rights to not change based on your charges.  If no one stands up for the rights guaranteed by the Constitution, those rights are useless.  Have we ever fought for someone who is guilty and won?  I am certain that it has happened.  If because of an attorney who gets a case kicked, the police are made aware that they will lose their case if they use illegal tactics even if the accused is guilty, the system is protected and rights are ensured. 

 

Criminal defense attorneys willing to take on any case are willing to protect the Constitution and make sure that the prosecution and law enforcement follow the rules.  For that reason, we take on any case because it is not the crime that matter: it is collectively the underlying principles guaranteeing you your Constitutional rights.


While at this point it should be obvious that we handle everything, there are some areas of law that require a note to explain why we handle those areas or why we are different in handling them.  In alphabetical order:
 

DRUG CRIMES

Every attorney that handles criminal law is happy to take a marijuana possession case.  To be perfectly upfront, there are so many of those charges, that we take an awful lot of these cases for clients.  However, some attorneys stop at the popular drug.  They want to be trendy and take the popular cases, but they simply will not take felony level charges, even simple possession. 

 

Whatever the drug, we realize that there are a myriad of circumstances that someone can face in life.  Some clients need help and need someone to fight to get court approved rehabilitative treatment.  Some clients are not eligible, but don’t need the rest of their lives ruined because they can’t shake a drug.  Some clients are going to party no matter what the court says.  And of course, we have seen possession with intent, trafficking, manufacture, and even associated RICO charges.  Do we shy away from these cases?  Not at all.  Constitutional rights are Constitutional rights.

SEX CRIMES

No crime is more villainized in the public eye than Sex Crimes.  Even having the charge, you have probably already faced scrutiny and actual damage to your life, even if you did not do it.  Whether you did what you are accused of or not, you have Constitutional rights and are entitled to a defense. 

 

When John Adams was chastised by his father for defending the accused British in the Boston Massacre, he responded that if we are not willing to apply our new rights equally, what was the point?  That is the system that I believe in and that my attorneys believe in.  We do believe in this system, and whether you did the crime or not, there are Constitutional rights you need to know about. 

 

Sex crimes more than any crime are crimes where having an attorney early can be game-changing.  Witness statements, evidence, and people’s willingness to help all change as a sex crime case moves forward.  Whether the accusation is inappropriate images on a computer, an inappropriate touching, or full on rape, the defense of most sex crime cases can only benefit from having an attorney early in the case.

THEFT CRIMES

Theft crimes are a touchy subject because no crime can harm job prospects more than theft crimes.  One of the most damaging things to someone’s future can be a simple theft crime.  Employers typically are less likely to fear being the victim of a violent crime, and even drug crimes are something employers will overlook, thinking of it as a problem one can get over.  Theft crimes, however, are almost always viewed as a moral failing. 

 

There are many reasons for theft crimes.  Paying rent to keep a roof over kid’s heads, a compulsion to take in the store, or a bad decision made in the heat of the moment.  In theft crimes, a lot of the argumentation is going to be about whether the accused is likely to commit a theft crime in the future, and the result of a theft charge can be life altering if not handled properly.

VIOLENT CRIMES

Some attorneys shy away from crimes of violence.  They want to do criminal law for the “clean” crimes and not the “messy” crimes.  White collar crimes or drug possession are often more profitable for the attorney, and certainly violent crimes are crimes the public likes to condemn.  From domestic violence to mass shootings, this has become the “untouchable” area of law in modern politics. 

 

As stated above, no matter the accusation, our job is to represent our client and protect his/her rights.  Crimes of violence are crimes where facts can really matter.  There are arguments of self defense, intent (in accidental injury cases), and often false statements.  When there has been a fight or physical altercation, false statements are prevalent, whether through someone trying to get out of trouble or simple exaggeration.  Witness statements and surveillance video can be crucial in showing how facts differ.
